This may be one reason why abortion advocates pressed the Food and Drug Administration very hard to expand the availability of medication abortions. And its collapse came for the same reason that slavery was ended — it was out of tune with the equal and essential justice named in the Declaration of Independence and borne down the generations by the better angels of human nature. As these centers grow in the extent and quality of their services, they not only offer women a life-affirming alternative for her baby but an option that affirms her own value as a human being. But it will take far more than another round of raw judicial power to shake the core commitments of champions of life. This bid to decentralize abortion and remove it from medical supervision — even encouraging it via telemedicine, where the woman receives no physical examination — is in the same spirit as the ruling in Hellerstedt. Texas and other states can and should continue to adopt and enforce laws that avoid repeats of the horrific conditions that prevailed in places like Kermit Gosnell's charnel house in Philadelphia.

We see this in the swift decline in the abortion rate in nearly every state of the union. Less than a year ago, no one could have predicted that the eloquent voice of Antonin Scalia would never again be heard to dissent in an abortion case. It elevates the risk to the woman's health (medication abortion complications rise sharply with gestational age as does the need for follow-up surgical abortion when the medication fails) with little consideration of the emotional and psychological impact on her. But there are other grounds, outside the confines of a single 5-3 court opinion, for pro-life activists to take heart and continue pressing their case. The abortion rate in 2015 was the lowest the United States has seen since 1973, the year Roe Ultrasonic Cell Disruption and Doe were decided.
